EB-2 National Interest Waiver (NIW)

To qualify for the EB-2 NIW, applicants must meet specific eligibility criteria:

Exceptional Ability: Applicants can qualify based on exceptional ability in their field, which is defined as having a degree of expertise significantly above that ordinarily encountered. Evidence may include:
 

• Letters of recommendation from recognized experts in the field, detailing the applicant's contributions and impact.

• Published material discussing the applicant’s work in prominent journals or industry publications.

• Membership in professional associations requiring outstanding achievements for membership.

• Professional achievements and recognition, such as awards, honors, or fellowships.
   

National Interest Requirements: To qualify for a National Interest Waiver, applicants must meet the three-prong test established in the Matter of Dhanasar case:

Substantial Merit and National Importance: The proposed work must address important national issues, contribute to the economy, enhance public welfare, or promote cultural or educational advancements. Examples may include groundbreaking research, innovations that impact public health, or contributions to environmental sustainability. 

Well-Positioned to Advance the Proposed Endeavor: Applicants must demonstrate their qualifications to advance the proposed work. This can include a strong history of relevant employment, advanced degrees, ongoing projects, and a detailed plan outlining their contributions.

Beneficial to Waive Job Offer and Labor Certification: The applicant must convincingly argue that waiving the traditional job offer and labor certification process is in the national interest. This often requires detailed narratives and evidence showcasing how the applicant's work aligns with U.S. national goals and how traditional pathways would impede their contributions.

The application process for an EB-2 NIW consists of several steps:

Step 1: Prepare Supporting Documentation

Compile comprehensive documentation, including:

• A detailed statement outlining the proposed endeavor and its national importance.

• Letters of recommendation from experts in the applicant’s field.

• Evidence of professional accomplishments (awards, patents, publications).

• Educational credentials (degrees, transcripts, credential evaluations if necessary).
   

Step 2: File Form I-140

Submit Form I-140, Immigrant Petition for Alien Worker, to the U.S. Citizenship and Immigration Services (USCIS). This petition must include all supporting documentation establishing eligibility for the NIW.
 

Step 3: File for Adjustment of Status (Form I-485) or Consular Processing

If currently in the U.S., applicants can file for Adjustment of Status using Form I-485 once their priority date is current. If outside the U.S., they must undergo consular processing at a U.S. embassy or consulate, which entails submitting a visa application and attending an interview.
